Fundamentally free or lawfully limited? In January 2016, Poland became the first member State to be subjected to the Rule of Law Framework due to concerns over its new laws on the Constitutional Tribunal and public media. However, sanctions through the framework are unlikely, as they would require unanimity from all Member States. How can the EU protect its core values effectively, whilst respecting Member States’ sovereignty?
